Recommendation for the application of Eike Berend Post admitted to an American Law School
The Law student Eike Berend Post has asked me to write him a recommendation letter for his application to an American Law School. I gladly do so, since I have gotten to know Mr. Post as a student of the Civil Law Bar Preparation course.
Mr. Post has received an unusual scholastic and university education. After high school in Germany, he stayed a year during 11th grade at an American High School, where he attended the courses for the 12th grade. At the same time he acquired his High School diploma there. The stay in the US became an important experience: After continuing German High School he decided after a couple of month that he wanted to go to University in the US and leave German High School. Thus he returned beginning 1997 to the US and began at Ithaca College and at Cornell University his studies in economics and mathematics. He transferred to the Interamerican University of Puerto Rico, where he earned the degree of Bachelor in Business Administration with the highest possible grade. In 1999/2000 he earned a Master in “European Business Law” and a Master in “Comparative Law” at the French University of Aix-Marseille III in Aix-en-Provence. Afterwards he acquired a Master in “Law and Economics” at the Erasmus University in Rotterdam, Netherlands.
Since October 2001 Mr. Post studies at the law faculty of the University of Osnabrück, where he at first earned a master degree in tax law and at the same time audited general law classes. Only since October 2002 is he officially inscribed in the law program and has completed all requirements to be permitted to the German bar exam. At the time he prepares himself for the bar exam, which also includes the participation at the university bar review courses.
Mr. Post has demonstrated in his prior educational development a very high ability and willingness to performance. He has completed all his studies in the least amount of time and with success. Also the performance in Osnabrück makes evidence of his legal abilities being well beyond average. This is not only shown by the high amount very good grades but also the fact, that Mr. Post completed a program within two semesters that takes at least two years. And above, it should not be forgotten that Mr. Post studied in the first two semesters here, winter 01/02 and summer 02, at the same time a Master in Tax Law with a heavy workload and completed it with clearly above average results.
I myself have gotten to know and to appreciate Mr. Post in my Civil Law Par Preparation course. In this course, that is attended by about 25 participants and that requires active participation, I have been able to observe closely the amount of knowledge of the participants. Already in the first lesson I remarked Mr. Post through his well thought out and contributing detailed knowledge to newer court decisions and developments of law. This very positive impression has proved to be correct during the semester. Mr. Post very clearly is among the best participants.
Also in a personal way does Mr. Post give a positive impression. He is friendly and modest, but understands to assert his point of view confidently. The joint work with him is very pleasant.
Mr. Post is pursuing a Master degree in tax law after the bar exam with the concentration in tax law. Such a degree would be an ideal continuation of his prior studies. I have no doubt that he will complete the course of studies successfully. A deep involvement with the American legal system, above all with the American tax system, would be a good addition to his knowledge acquired at the University of Osnabrück. At the same time he could attain his career objectives (tax adviser and CPA).
In summary, I arrive at the conclusion that I fully support the application of Mr. Post to an American Law School.

1. How long have you known the applicant and in what capacity?
I have known the applicant, Eike Berend Post, as a fellow student in the Erasmus Master Program in Law and Economics since January 2001.
2. What do you consider the applicant’s strength? You may wish to comment on breadth of knowledge and quality of oral and written expression in English.
Eike has a genuine interest in learning. He quickly understands complex lines of argument and seems to love improving theories and applying newly acquired knowledge in different contexts.
Eike is extremely talented when it comes to languages. I can’t say how many languages he speaks fluently, but I have heard him having conversations with people in at least five different languages. He speaks English almost without any accent; meaning with an American accent. I am not able to comment on his written expression in English.
3. Describe any activity or program in which the applicant was involved that illustrates his or her special abilities, and/or leadership skills or potential.
I am only able to comment on Eike’s activity in and around class. I have observed Eike at several group presentations that were held in class. In every presentation Eike took the lead. I did one presentation together with Eike. In the preparation for the presentation he showed that he knew how to reinforce individual capabilities by carefully checking people’s interests. He initiated a fair and smart distribution of the workload and I think everybody had a feeling of involvement. Moreover, I must say that he was fantastically good at finding material in addition to that provided by the Professors.
I know that other groups profited greatly from Eike. Eike contributed most to the presentations but never complained. He tried to involve all the group members in the presentations and let them answer questions to which they knew the answers. When difficult questions came up, Eike discreetly and correctly took care of them himself.
I also know that for many students, including me, Eike provided assistance before exams and gave good advice for improvement of papers and assignments. I believe Eike was particularly appreciated since he patiently listened to ideas and could make difficult things much clearer.
4. What do you consider to be the applicant’s weakness?
There are really few weaknesses I could think of. One might be that to outsiders he may appear too self-confident. In every class I attended, Eike was the person who participated the most. When Professors posed questions, Eike always raised his hand and had a correct answer and most often some kind of reflection on the topic ready while the other student still were trying to find the right answer. In front of class, he was always well prepared and at the lectures he wanted to go further than what was indicated in the distributed material. Many times he went beyond what the Professors intended to teach in the class. This created some annoyance among our fellow students. I even think that among some Professors Eike was feared, because several times he corrected them or did not accept their opinion. All this helped to create some animosity towards Eike among people who did not know him.
5. What do you feel would be the applicant’s greatest difficulty in an intensive graduate professional course of study? This would be an area where the applicant ought to receive additional preparation if admitted.
I have no doubts that Eike would be a successful student at Harvard University. The only thing I could imagine is that he would focus too little on what is exactly required by the people evaluating his performance. As I said above, Eike often tried to go beyond what we students were supposed to learn. I think it might be because of this that Eike didn’t get extremely high grades, as he told me.
6. Additional comments about the applicant’s potential or personal qualities.
A few comments on how I have rated Eike on the recommendation form:
I do not exaggerate in marking “equal to the best” on the characteristics of native intellectual ability, analytic frame of mind and problem solving orientation. I think everyone in the Master Programme would agree that Eike was the best student of the programme. I, myself, have studied at university for six years and also taught at Linköping University. During those years, I think I have not met anyone with a higher intellectual capability and problem solving orientation.
Now, as a Member of the Swedish Parliament, I can see that he is able to skillfully analyze social problems with his logic and economic understanding and find intriguing solutions. During the last months, I have called Eike several times to get his point of view on certain political issues. Every time he’s been able to quickly understand and reflect upon problems from different angles. For example, I recently asked him about the pros and cons of Co2 permit trading. He gave a good overview of different aspects to consider and gave examples of solutions imaginable to solve associated problems. Some of these solutions I had never heard of and Eike said that he came up with these solutions himself. The same happened when we discussed a macro economic issue such as the stability pact of the EMU-countries.
I also rated Eike very highly on commitment to public service. I am not sure if he is currently involved in any public service, but when I asked him about his goals for the future and why he is working so hard, he explained that at the end of his life he wanted to be able to know for himself that he did everything he could to help others. In the program, Eike was very supportive and helpful to his fellow student, even to such a degree that I sometimes felt that some students used his kindness.
Eike has become a friend of mine. Also he has done me many favors, as I mentioned above. Nonetheless, everything positive I wrote is what I honestly think. Eike is an excellent student and I am convinced that also at Harvard University he will be successful. Therefore, I have no hesitations whatsoever in recommending Eike Berend Post.

Eike Berend Post was a fellow student in the LL.M. program in European Business Law in France in the academic year of 99/00. It was a fairly small program, about 20 students, so that I was able to observe and get to know him during the one year.

Eike Berend Post took two courses of mine (Economic Analysis of Contract Law and Methodology and Selected Topics in Law and Economics) at Ghent University last year, as part of his European Master in Law and Economics degree. For both he obtained 9.5/10, which is an exceptional mark (not awarded every year). He was by far the best of the over 30 students of that year. Moreover, I consider him as one of the best students I have ever had. For my classes, he wrote (jointly with 2 other students) 4 papers. In the presentations he clearly took the lead.
Eike Post is exceptionally intelligent. His ability to make original analyses of problems is outstanding. By “outstanding” I mean that he has the talent to become a brilliant scholar. He is talented especially for interdisciplinary research: he has the mathematical and visualizing skill of excellent economists and the verbal talents of excellent lawyers. In addition, he is a very good organizer, and a hard working and highly motivated student with above average social skills. His English is extremely good.

Eike is an ideal team leader, co-founder and entrepreneur.
I have first gotten to know him as an ideal team leader and later as an ideal co-founder. I first worked for his company Fiscalio and later I started my own company Contractor Union with him as a co-founder.
While working at Fiscalio I worked in the same office as Eike, one other employee and one intern. The other employee, intern and me did not understand much about the tax planning and financial question behind the company. Eike however was always willing to give us more knowledge then we needed. So that I was able to learn many things from the work and from him. Thus everybody in the company felt motivated, liked Eike and accepted his authority.
At a later stage Eike offered me to be co-founder of Contractor Union, so that we build the company together. Even though many negative things happened to the company – our cooperation Partner in the Isle of Man, did not deliver the service correctly, interns did not work as they should have and finally the UK government close the tax loop hole- Eike seemed to never have a bad day. He always remained positive and determined to succeed. It was his motivation that also motivated me.
When the tax loop closed Eike started a web business but we remained in close contact. He worked in India, Romania and China for most of the time in order to build the company. I know that even though he had a lot of bad luck, in which everybody else I know would have long given up he continued the business.
